The Local Plan is a statutory
document prepared by the Borough Council to set out its planning
policies for the development and use of land. Together with
the Cumbria and Lake District Joint Structure Plan and Cumbria
Minerals and Waste Local Plan, both prepared by Cumbria County
Council, it formed the statutory Development Plan for the area. As
of 28 September 2008, a number of Structure Plan policies have
been cancelled. All Minerals and Waste Local Plan policies
are also now cancelled. (See
http://www.planningcumbria.org/).
As a result of the Planning and
Compulsory Purchase Act 2004, the national system for producing
planning policy documents changed and we are still in a
transitional phase between the old and the new systems.
The old development plan system
described above has been replaced by a new system comprising a
Regional Spatial Strategy (RSS) and Local Development
Frameworks (LDFs). Under the transitional arrangements, the old
style Local and Structure Plans are saved, initially for a
limited period, or until such time as they are replaced
in whole or in part by the new LDF documents and revised RSS as
these are produced. The RSS, which was adopted in September
2008 and became part of the Regional Strategy (RS) in April
2010 is now revoked and the government have indicted that
RS's will be abolished shortly.
The Local Plan saved* by Barrow Borough Council consists
of:
- Barrow-in-Furness Borough Council Local Plan Review 1996-2006
(Adopted 24th August 2001); and
- The Housing Chapter Alteration 2006 (Adopted 2nd June
2006)
*Please note:
As of 28 September 2007, Policies A2, D14, F17 and
G11 of the Local Plan Review were cancelled; and as of the 2
June 2009, Policy B2 of the Housing Chapter Alteration 2006 was
also cancelled.
The adoption of the Barrow Port Area Action Plan Development
Plan Document on 12 July 2010 has resulted in the cancellation of
Policy A15 of the Local Plan and the superseding in part of a
number of other policies. The AAP supersedes all the Local
Plan allocations with in the Barrow Port AAP Area, apart from the
Ground 'Water Protection Area Relating to the Major Aquifer'.
Viewing the Saved Local Plan
The saved Local Plan, in the form
that it was adopted in 2001 and formally Altered in 2006, can still
be seen below as a static version of the text and maps. Care should
be taken viewing these document as a number of the policies and
allocations they show are now superseded. The maps also only
show the constraints as they existed when the Plan was adopted
in 2001 (or Altered in 2006). They are provided for reference
only.
Please note: It is
recommended that you view the interactive version of the
'Barrow-in-Furness Adopted Proposals Map' which shows the up to
date development plan policies of the Local Development Framework
and the remaining saved policies of the Local Plan.
The interactive Adopted
Proposals Map
(currently being
updated) is available through the Council's Web
Mapping Service and can be seen by following the

The Development of the Local Plan
The Council first adopted a Borough-wide Local Plan in
November 1991. The nominal end date for the Plan was 1996 and
a comprehensive Review of the document was carried out resulting in
the Barrow-in-Furness Borough Council Local Plan Review 1996-2006,
which was adopted on 24 August 2001. The Council recently
altered the housing chapter of this Local Plan Review document
and this Housing Chapter Alteration was adopted on 2 June 2006. The
stages of the recent Alteration leading to its formal adoption are
set out below for information.
Issues Paper & Deposit Versions
An altered housing chapter was placed on First Deposit on
the 4th May 2004 for a six week period ending on the 18th June. A
copy of this document is available to download below.
Following publication of the First Deposit, the Council
considered the representations received in response to that
document. It agreed to a number of further changes and issued
a Second Deposit version of the alteration for a six week period
ending on 10th December 2004. A copy of this document is
available to download below.
Public Inquiry & Inspector's Report
A Public Inquiry was held into the outstanding objections to
the proposed alteration in April 2005. The Inspector's Report
following the Public Inquiry was issued in July 2005.
Proposed Modifications
The Council considered its response to the Inspector's Report
in January 2006 and advertised that it did not intend to
accept all of the Inspector's recommendations and also
proposed to make further modifications. Representations on these
modifications were invited during the period 10 February
2006 and 17 March 2006. The proposed modifications, together
with the Council's responses to the Inspector's
recommendations, are set out in the Statement of Reasons and
Decisions below. There is also a copy of the draft Housing Chapter
Alteration showing the proposed modifications.
The Council considered its response to the representations
received in respect of the proposed modifications in April 2006 and
advertised its intention to adopt the proposals after 1 June
2006.
Adoption
The Housing Chapter Alteration was adopted by the Council on 2
June 2006. The adopted documents and Notice of Adoption can be
viewed below.
