Our Policy
"The councils policy on Property Searches has always been to
ensure that we provide an efficient and responsive service for
Property Searches falling under auspices of The Local Authorities
(England) (Charges for Property Searches) Regulations 2008. The
policy does not cover requests made under the Environmental
Information Regulations 2004, as these are not dealt with by the
Land Charges section and a separate policy applies to these
requests.
To ensure the Council encourages regeneration and growth within
Barrow it is important that the council can service requests for
Property Searches as efficiently and as responsively as possible.
To this end the Land Charges section are charged with concentrating
their resources on maintaining the data held, responding to
official searches submitted to the Council and for requests to view
data using our enhanced personal search service that are made
under the Local Authorities (England) (Charges for Property
Searches) Regulations 2008. The council provide an online service
for requesting official searches that enables users of the service
to apply for official searches quickly and easily. We also try to
return responses electronically in order to ensure as fast as
possible turnaround. The council will aim to provide access to its
enhanced service under these regulations within 5 working days
wherever possible."
As well as the enhanced personal search service the Council also
provides free access to view the raw data used in our
official searches and the enhanced service, under the Environmental
Information Regulations 2004. Requests made under these Regulations
will be answered as soon as possible and no later than 20
working days AFTER the date of receipt, unless an exception
applies or reference to a third party is made. There may a fee
payable for this information (excluding inspection which is free of
charge). This will be considered and you will be informed if a fee
is payable. In this event the fee must be paid before the
information is processed and released. The 20 working day time
limit for responses is suspended until receipt of the payment. If
you are requesting to view the information only then you will be
given an appointment to do this within the 20 working days. EIR
requests are processed in an sequential order with all other
requests received for Council Information. Consequently requests
will take longer to process than ones made to use the enhanced
personal search service. EIR average response time is 12 working
days. Enhanced personal search service is 5 days.
